1. Agreement to Terms

This website is operated by ZeltaCollections AU (“we”, “us”, “our”). By accessing our site and/or purchasing products, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms”). These Terms apply to all users of the site, including browsers, vendors, and customers.

2. Business Specialization & Intellectual Property

ZeltaCollections AU is an independent retailer of authentic Trading Card Game (TCG) products, including Pokémon, One Piece, Dragon Ball Super, and Riftbound.

Affiliation Disclaimer: ZeltaCollections AU is not affiliated with, endorsed by, or sponsored by The Pokémon Company, Bandai, or any other trademark owners. All intellectual property remains the property of its respective owners.

Product Integrity: We guarantee that all sealed products are sourced from authorized distribution channels and have not been searched, weighed, or tampered with.

3. Online Store & Eligibility

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

 

4. Pricing & Market Volatility

Currency: All prices are in AUD (Australian Dollars).

Volatility: Due to the inherent nature of the TCG market, prices are subject to change without notice. We do not offer price protection or refunds if market prices fluctuate after your purchase.

Errors: We reserve the right to cancel orders arising from "obvious errors" in pricing or technical glitches.

5. Order Management & Cancellation Policy

To maintain our high dispatch standards, we enforce a strict fulfillment timeline:

Cancellation Window: Requests to cancel or modify an order must be received via email within two (2) hours of order placement.

Restocking Fees: All approved cancellations (including pre-orders) are subject to a 25% administrative and restocking fee to cover non-refundable merchant costs.

Right to Refuse: We reserve the right to refuse service, limit quantities, or cancel orders suspected of "scalping," automated bot purchasing, or fraudulent activity.

6. Pre-Orders & Allocations

Estimates: Release dates are provided by distributors and are estimates only.

Allocations: In the event of a distributor short-print or allocation cut, we will fulfill orders in the sequence they were received. If we cannot fulfill your order, a full refund will be provided.

The "One Shipment" Rule: Orders containing both in-stock and pre-order items will be held until all items are available for dispatch.

7. Shipping & Risk of Loss

Dispatch: Orders are typically processed within 1–2 business days.

Transfer of Risk: Risk of loss and title for products pass to you upon our delivery to the carrier (Australia Post).

Delivery Issues: We are not responsible for courier delays. If a parcel is marked "Delivered" but not received, you must initiate a formal inquiry with the carrier before contacting us.

8. Returns & Australian Consumer Law (ACL)

Our products come with guarantees that cannot be excluded under the ACL.

Final Sale: Due to the collectible nature of TCG products, all sales are final. We do not accept returns for "Change of Mind."

Discrepancy Claims: Any damaged or incorrect items must be reported within 48 hours of delivery with photographic evidence. Claims made after this window are strictly ineligible for resolution.

Sealed Integrity: Once a factory seal is broken, the product is ineligible for return under any circumstances.

9. Chargebacks & Disputes

Initiating a chargeback without first attempting to resolve the issue with our support team is considered a breach of these Terms. We reserve the right to dispute such claims with provided evidence of delivery and to restrict future access to our Services for accounts associated with frequent disputes.

10. Limitation of Liability

ZeltaCollections AU shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, or consequential damages of any kind, including lost profits or lost savings, arising from your use of any of our products or services. We do not guarantee specific "pulls," card grades, or future investment performance.

11. Governing Law

These Terms and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of Victoria, Australia.
